Some player's IQ isnt high enough for !p function

Id like to open a discussion for the possibility of removing the !p function. After some thought, I think we could potentially keep !f and get get rid of !p for best effect.
Essentially:
Some people are $$%$#%$#%$#%$# idiots and will run in front of tanks, lavs, soldiers opening fire, etc etc on purpose or as a consequence of their stupidity. This isnt that much of a problem when u get punished as a soldier, but when u get punished piloting or driving this is a huge detriment and sometimes leads to vehicles being stolen by the enemy team.
Now, karek pointed out that in discord that the nice thing about punish and forgive is that if someone used their fucking brains to realize a tk was accidental, they can forgive so that it doesnt count against someone. However, if they dont use their fucking brains or it really was an intentional tk, then not forgiving, instead of actively punishing, should suffice I think. Since the server has an automatic 5 tk's (if unforgiven) before kick anyway, even if you remove punish, people who are repeatedly tking, either by accident or purpose, will get kicked anyway. And that way, fools cant use !punish to troll or negatively impact their team anymore, especially when tk's are by accident.
What do you guys think?

Are we not able to tweak the script at all?
It actually occurred to me this morning, instead of disabling !p, would be it possible to remove the killed in action aspect of it? So u still get a punish that counts towards the 3 before kick, but you dont get killed in action. It would solve the problem without actually removing !p, just making a small change.
I dont think we need to remove team killing, it is part of the HC experience.
Id be willing to look into how the script is written and try to write the adjustment (I have some programming experience).

Heres an example of why at least the killed in action aspect needs to be removed from !p.
For some background: our team was doing fucking awful, the gunner in the enemy tank had a 38 kill streak. So I spawned in a tank to help the team and take it out so we can cap and keep a bloody flag, and I accidentally run over some blueberry. I usually type sorry in chat if I tk but I was a little preoccupied, and I think the idiot would have punished even if I said sorry. As a result, I get fucking killed in action, and in HC its impossible to respawn in a vehicle unless ur squad leader is in it. pcmorris isnt an idiot, but some gunners will bail out of the tank if the driver leaves, leaving it potentially for the enemy to steal.

well, this is the situation... pardon me

you're playin Hardcore like Gulmond, you dont run the tank like that on HC, never ever even if you gonna die
(that's why when am using the Tanks at RC1, get my nerves, everyone just runaway like wild horses and in the way
the run over anyone, just cuz they gonna be rocked in tha face)

why?, cuz is Hardcore, you kill ppl left and right, you run from rockets and in the way of runaway,
you kill infantry behind you, that count on you to move foward, there's no map to spot ppl,
they dont know where you coming, even if they hear you rushin away

this video probes it.... the !P is exactly for that reasson, and i learn it on the hardway,
putting claymores everywhere, that's why i started to use C4, even the frags arent that great on HC

Nah I dont think you get it Shiryu. I was looking behind me to make sure I wouldnt run people over, and I saw the 2 guys behind the wall near me but wasnt expecting them to run out from behind it. It was simply an accident, and you can ask people who play with me on HC, I dont team kill that often because I try to be careful. Like I said before, it should be enough to !p someone and have it count as one of the three before they get kicked. But to get killed in action while im driving a tank while Im trying to help my team cap and defend flags? Thats bullshit. People like HC because it more 'realistic' but getting killed in action because someone !p isnt very realistic.
